  • Accounts may be shared at the discretion of the account administrator. However, shared credentials increase security risks, particularly for sensitive Observability data. OtterMon AI is not responsible for security breaches or damages caused by shared account use.
  • Users must register with accurate information and keep their account details secure.
  • Accounts must be used for legitimate, legal business purposes only.

3. Subscriptions, Billing, and Cancellation

  • OtterMon AI offers free and paid subscription plans, with monthly or annual billing options.
  • Customers on self-service plans can cancel through the product interface. Service continues until the end of the subscription period; no refunds are provided.
  • Customers on enterprise or contracted plans must notify their OtterMon AI account representative in writing at least 30 days prior to the end of the subscription term to avoid renewal.
  • We reserve the right to suspend or terminate services for non-payment.

4. Acceptable Use

Users agree not to:

  • Use the service for unlawful, fraudulent, or harmful purposes.
  • Upload or transmit malicious code, malware, or harmful data.
  • Interfere with or disrupt the integrity, performance, or security of the service.
  • Reverse engineer, decompile, or otherwise attempt to derive the source code of the service.
  • Access or attempt to access other users’ data without authorization.
  • Use the service for spam, abusive behavior, or unauthorized advertising.
  • Allow competitors to use the service for benchmarking or competitive purposes without written authorization from OtterMon AI.

5. Intellectual Property

  • All content, trademarks, logos, and intellectual property on the website or within the product belong to OtterMon AI Inc.
  • Users retain exclusive ownership of raw telemetry data uploaded to the service.
  • OtterMon AI may:
    • Process and store raw data to provide services.
    • Create and maintain processed distillations (e.g., insights, anomalies, summaries) as part of delivering value.
    • Collect, retain, and analyze anonymized, aggregated trends to improve services for all users.

6. Beta Features and Third-Party Integrations

  • Any beta or experimental features are provided “as is,” with no guarantees of reliability, accuracy, or continued availability.
  • Our service may connect with or rely on third-party providers (e.g., Google Analytics, hosting, DevOps tools). OtterMon AI is not responsible for third-party services and disclaims liability for any issues caused by them.

7. Warranties and Disclaimers

  • The services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • We do not guarantee uninterrupted, error-free, or secure operation of the services.

  • To the maximum extent permitted by law, OtterMon AI shall not be liable for any indirect, incidental, special, consequential, or exemplary damages.
  • Our total liability is capped at the amount you have paid to us in the preceding twelve (12) months.

9. Termination

    • Breach of these Terms.
    • Non-payment.
    • Extended inactivity.
  • Individual users may delete their accounts at any time.
  • Organization-level accounts may be suspended or terminated upon request by an authorized administrator.

10. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles.
  • Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
  • Users waive the right to participate in class actions or class-wide arbitration.

11. Export Control and Compliance

  • Users may not use the services in violation of U.S. export control laws or applicable trade sanctions. This includes use in sanctioned countries or by restricted parties.
